commercial criminal law and fiscal criminal law

We handle criminal law cases that are often closely connected with other areas of our practice. In particular, we provide legal assistance in criminal proceedings concerning commercial crimes – so-called white-collar crimes (e.g. acting to the detriment of a company – Article 296 of the Polish Criminal Code, offences against the credibility of documents, fraud, etc.) – as well as fiscal and tax offences.

These matters primarily concern liability arising from running a business, holding positions in companies’ governing bodies, and the related tax obligations. We offer comprehensive legal support in these fields (both as defence counsel and as attorneys representing injured parties). We represent our Clients at every stage of the proceedings – both in preparatory proceedings and in court.

In these cases, we combine expertise in criminal law and commercial law, which allows for a broader perspective and an effective, multi-faceted defence of our Clients’ interests. An in-depth understanding of business processes and the specifics of various types of transactions, gained through years of practice, is particularly important in fiscal criminal cases. These proceedings often involve complex factual backgrounds and require knowledge not only of criminal law, but also of other branches of law.

We also have extensive experience in representing and defending public officials in criminal proceedings.

Examples of cases to date include:

  • defending a public official accused of falsifying company documents (concluded with a discontinuance),
  • defense of a municipal official in a case involving charges of acting to the detriment of the municipality (ended in acquittal),
  • defense of the mayor in a case of accepting financial benefits (ended with a dismissal),
  • defense in cases of board members of capital companies charged with acting to the detriment of those companies (ended with acquittal),
  • defence of a trader accused of unauthorised acceptance of dues in the form of cash (ended with acquittal),
  • interventions in cases of construction disasters – developing a strategy for dealing with them,
  • representation of injured victims and defendants in cases involving liability for construction site accidents, including fatal accidents.
