Disputes with social security and labour authorities

We provide end-to-end legal support for employers and contribution payers in disputes with the Social Insurance Institution (ZUS) and the National Labour Inspectorate (PIP). Our assistance begins at the pre-audit stage – immediately after receiving a control notice – and continues through all phases of the proceedings: control, administrative, and judicial, including post-dispute settlement.

Thanks to extensive experience in handling complex and large-scale cases, we effectively mitigate risk and protect our clients’ interests. Attorney Robert Adamczyk, who leads this area at the firm, has successfully conducted over 100 court proceedings against ZUS, including multi-million zloty disputes involving hundreds of contested decisions.

Strategic legal advice at every stage

Early-stage actions often prove decisive for the final outcome. In disputes against powerful institutions with substantial resources, precision in legal strategy is critical – not only to achieve a favourable result, but also to optimise costs and minimise the operational impact of the dispute.

We offer rare and highly specialised legal expertise in the field of social insurance law, allowing us to successfully navigate even seemingly hopeless situations. We also advise on individual matters – particularly regarding pensions and social benefits – based on up-to-date case law and regulatory practice.

Scope of services

We advise and represent clients in matters involving:

Legal advisory and prevention:

  • analysis and structuring of employment contracts, management contracts, and civil law agreements in terms of their insurance and contribution implications;
  • planning and implementing legally secure contribution optimisation solutions;
  • designing internal procedures and compliance strategies in preparation for audits.

Support during inspections:

  • representation before ZUS, PIP, and the Sanitary Inspectorate (in relation to workplace environment);
  • drafting formal responses and objections to inspection reports;
  • legal advice and representation in administrative proceedings up to the issuance of decisions.

Litigation and dispute resolution:

  • legal strategy development following negative administrative decisions;
  • preparation of appeals and representation before social insurance courts;
  • post-litigation assistance, including advisory support with settlements, overpayments or underpayments (note: we do not prepare technical ZUS forms or declarations).

We provide not only effective resolution of ongoing issues but also future-oriented legal strategies. Our recommendations are tailored to our clients’ operations and based on legally sound and reliable solutions, for which we take full responsibility. We ensure that all advice is aligned with applicable laws, administrative practices, and judicial trends.
