Even if the plot adjoins a public road, there is no guarantee that a consent to enter the road will be obtained, which many investors have already found out. This time the owner of a real estate, who first encountered a refusal from the office to allow an entry from his plot, found out about it painfully. Then he tried to gain access to a public road through a neighbouring property, applying to the court for establishing an easement of a necessary road. The justification for the application was that his property does not have adequate access to a public road. In the course of the proceedings, there was interesting expert opinion evidence concerning technical requirements of roads and the possibility of adapting the road to these requirements. This situation confirms, however, that before buying a property it is good to conduct an audit of it.
